Land Use and Zoning

Land use and zoning essentially involves government regulation on the use of land.  Under its police powers governments can regulate uses of land based on health, safety and welfare concerns.  This involves cities establishing different zoning ordinances and codes and the state establishing development regulations as well.  A quick glance at any municipal zoning code will reveal a myriad of regulations intended to control the construction of improvements and use of land.

New Jersey regulates land use through a number of laws including the Municipal Land Use Law found at New Jersey Statutes section 40:55-1 et seq. and the Local Redevelopment and Housing Law found at New Jersey Statutes section 40A:12A-1 et seq.  The state also provides land use regulation through the Highlands Water Protection and Planning Act, Pinelands Protection Act and Hackensack Meadowlands Reclamation and Development Act.  These acts are implemented by the Highlands Council, Pinelands Commission and Meadowlands Commission respectively.  In addition to the above, the New Jersey Department of Environmental Protection is intimately involved in the land use process through its oversight of issues such as environmental management and stormwater regulation.  While not exhaustive, the above indicates the intricate nature of obtaining land use and zoning approvals and the need for competent guidance throughout the process.
